In exchange for Mad Catter Cafe Inc. (“Cat Café”) allowing the guest named below (“Guest”) to enter Cat Café’s premises (the “Premises”) and lounge (the “Lounge”) and to interact with the cats and/or kittens located on the Premises in accordance with Cat Café’s rules and at Cat Café’s standard rates, and for other good and valuable consideration the adequacy and receipt of which is acknowledged, Guest and, if Guest is a minor, Guest’s Parent(s) and/or Legal Guardian(s), hereby agree as follows:

 

1. The undersigned understands, appreciates, and acknowledges that Guest’s presence in the Premises, as well as Guest’s interaction with the cats and/or kittens located in the Premises, involves an inherent risk of injury and illness for Guest including but not limited to injuries and illnesses such as scratches, bites, cuts and abraisions, contusions, allergic reactions and zoonotic diseases such as bacterial, parasitic, fungal, protozoal, and viral infections. Guest is aware and fully understands the inherent dangers involved in being in the presence of and/or interacting with cats and/or kittens, including the risk of death and/or personal injury or damage to the Guest, other persons, Guest’s property, and/or the property of others while the Guest is located on or in the Premises, in addition to the inherent risk of illness associated with bringing food and/or beverage into the Lounge for consumption. The undersigned further understands, appreciates and acknowledges that the dangers and risks may also impair Guest’s ability to earn a living, engage in other business, social, and recreational activities, and to generally enjoy life.
    

2. WAIVER OF RIGHTS AND RELEASE OF LIABILITY, The undersigned hereby releases, waives, and discharges Mad Catter Café Inc., its members, managers, employees, agents, and partners, to the fullest extent permitted by law, from any and all liability, claims, demands, actions, or causes of action of any sort on account of damage to personal property, loss of companionship, or personal injury, illness, or death whichmay result from Guest’s presence on or in the Premises, Guest’s interactions with the cats and/or kittens located on or in the Premises, or Guest’s decision to bring food and/or beverages into the Lounge for consumption. This release includes claims based on the negligence of Mad Catter Café Inc., its members, managers, employees, agents, and partners, but expressly does not include claims based on their recklessness or intentional misconduct or gross negligence.
    

3. WAIVER OF RIGHTS AND RELEASE OF LIABILITY, The undersigned hereby releases, waives, and discharges the City of St. John’s, its members, managers, employees, agents, and partners, to the fullest extent permitted by law, from any and all liability, claims, demands, actions, or causes of action of any sort on account of damage to personal property, loss of companionship, or personal injury, illness, or death which may result from Guest’s presence on or in the Premises, Guest’s interactions with the cats and/or kittens located on or in the Premises, or Guest’s decision to bring food and/or beverages into the Lounge for consumption. This release includes claims based on the negligence of the City of St. John’s, its members, managers, employees, agents, and partners, but expressly does not include claims based on their recklessness or intentional misconduct or gross negligence.
    

4. The undersigned agrees to abide by all rules and regulations that Cat Café may impose regarding the cats and/or kittens and agrees to undertake all activities in a responsible manner. If the undersigned is unwilling or unable to follow any rules, Cat Café reserves the right to terminate the continuation of any such activities and ask Guest to leave the Premises without advanced notice or return of any admissions paid to enter the Lounge.
    

5. The parties agree that the provisions of this agreement are severable, and that the invalidity or unenforceability of any one or more of the provisions or clauses of this agreement shall not affect the validity or enforceability of the other provisions or clauses of this agreement. This agreement is made pursuant to and shall be governed by the laws of the Province of Newfoundland and Labrador (without regard to the laws that might be applicable under the principles of conflicts of law, and without regard to the jurisdiction in which any action or special proceedings may be instituted), as to all matters, including but not limited to matters of jurisdiction, validity, property rights, construction, effect and performance.

BY EXECUTING THIS RELEASE, I acknowledge that I have read this release, understand the contents hereof, have been advised and had the opportunity to seek independent counsel of my choice and certify that I have freely and voluntarily executed this release. I acknowledge that, but for the execution of this release and agreeing to be bound by the terms hereof, Mad Catter Café Inc. would not authorize me to participate in any activities at Mad Catter Café Inc.
